Today the US Bankruptcy Court granted final approval to a $790,000 class action settlement Gardner & Rosenberg secured for former employees of New England Confectionary Company (“NECCO”). The workers alleged that the purchasers of NECCO violated the federal “Worker Adjustment and Retraining Notification Act” (known as the WARN Act) by failing to provide sufficient advance notice of the shutdown of the NECCO plant in Revere, Massachusetts in July 2018. The class members, most of whom are low wage earning immigrant workers, will receive significant payments. Read copies of the Motion for Final Approval and Approval Order.
